Who we are

Kaka Social is a WhatsApp-first marketplace that connects local businesses and individuals in India with verified district creators for reels, posts, shoots and social uploads. This policy covers our website at kakasocial.in, our WhatsApp conversation flow, and the dashboard used by businesses and creators.

For the purposes of Indian data-protection law (including the Digital Personal Data Protection Act, 2023), Kaka Social is the data fiduciary for personal data processed through the service.

02

Information we collect

We collect only the information we need to run the service:

  • Account details — name, phone number, email, business name, city/district and preferred language.
  • Verification data — for creators, KYC inputs such as PAN, bank account details and portfolio links.
  • Briefs & content — voice notes, text, images and references you share to describe what you need.
  • Transaction data — milestones, invoices, payment status and payout history (financial credentials are handled by our PCI-DSS compliant partners, never stored on our servers).
  • Communications — messages exchanged inside the WhatsApp thread and in-app chat.
  • Device & usage data — browser type, IP address, device identifiers, pages visited and timestamps, collected automatically.

03

How we use your information

  • Create and operate your account, verify identity and prevent fraud.
  • Match briefs with suitable creators and present quotes for your approval.
  • Process milestone payments, issue GST-compliant invoices and release payouts.
  • Review delivered content for compliance before it reaches your audience.
  • Send operational notifications about your requests, quotes and payments.
  • Improve the product, debug issues and build aggregated insights (never user-identifiable).
  • Meet legal, regulatory and audit obligations.

04

Legal basis for processing

We process personal data on the following lawful grounds: your consent (given when you sign up and when you agree to a brief or quote); the performance of a contract (so we can deliver the service you asked for); our legitimate interests in running and securing the platform; and compliance with legal obligations such as tax and KYC rules.

05

How we share information

We share personal data only in these specific situations, and only to the extent needed:

  • With the creator or business you choose to transact with — so they can discuss, deliver and get paid for the work.
  • With payment partners (e.g. Razorpay, Cashfree) to process milestones and payouts.
  • With service providers for hosting, analytics, email and messaging — bound by confidentiality and limited to processing on our instructions.
  • With tax and regulatory authorities where disclosure is required by law.
  • In a corporate transaction (merger, acquisition or restructuring), subject to equivalent protection.

We do not sell your personal data, and we do not share it with advertisers.

06

Data retention

We keep personal information for as long as your account is active and as needed to provide the service. After deletion, we may retain certain records (invoices, KYC files, dispute logs) for up to 8 years to meet statutory tax, accounting and anti-fraud obligations. Backups age out on a rolling 90-day cycle.

07

Your rights

You can, at any time, ask us to:

  • Access the personal data we hold about you.
  • Correct inaccurate or incomplete information.
  • Delete your account and associated data (subject to the retention rules above).
  • Receive a copy of your data in a portable format.
  • Withdraw a consent you previously gave.
  • Opt out of non-essential marketing messages — operational messages about active briefs will still be sent.

To exercise any of these rights, write to our Grievance Officer at privacy@kakasocial.in. We will respond within 30 days.

08

Cookies & similar technologies

Our website uses a small number of first-party cookies to remember your theme preference and keep you signed in. We use privacy-respecting analytics to understand page performance in aggregate. We do not use cross-site tracking cookies.

09

Security

We protect your data with industry-standard measures: TLS encryption in transit, AES-256 encryption at rest, principle-of-least-privilege access controls, continuous monitoring and regular security reviews. However, no system is 100% secure — if you suspect a breach of your account, notify us immediately so we can act.

10

Children’s privacy

Kaka Social is not directed at individuals under the age of 18. We do not knowingly collect personal data from minors. If you believe a minor has provided us with information, please contact us so we can remove it.

11

International transfers

Our primary servers are in India. Some service providers may process data in other jurisdictions; where that happens, we rely on standard contractual safeguards to ensure a comparable level of protection.

12

Changes to this policy

We may update this policy from time to time. Material changes will be notified by email or in-app at least 15 days before they take effect. The “Last updated” date at the top of this page always reflects the current version.
